HOW CONSUMER LAW RELATES TO THIS WARRANTY
For local consumers: The rights described in this warranty are in addition to the statutory rights to which you may be entitled under the Consumer Protection (Fair Trading) (Amendment) Act 2012 and other applicable consumer protection laws and regulations. Our goods come with guarantees that cannot be excluded under the Consumer Law.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM COUNTRY OR PROVINCE. OTHER THAN AS PERMITTED BY LAW, MAKA GPS TECHNOLOGIES DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROM THE NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.
WHAT IS COVERED BY THIS WARRANTY?
MAKA GPS TECHNOLOGIES warrants all “RETAIL-PURCHASED” MARBELLA-branded hardware product and in the original packaging ("MARBELLA Product") against defects in materials and workmanship when used normally in accordance with MARBELLA's published guidelines for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser ("Warranty Period").
Other “RETAIL-BUNDLE” MARBELLA-branded hardware, MARBELLA-branded premium gifts and accessories as; car charger, window suction mount, stylus, related electronics or video cable from original packaging against defects in materials and workmanship when used normally in accordance with MARBELLA's published guidelines for a period of SIX (6) MONTH from the date of original retail purchase by the end-user purchaser ("Warranty Period").
All Repairs have a NINETY (90) DAYS warranty. If the unit sent in is still under its original warranty, then the new warranty is NINETY (90) DAYS or to the end of the original ONE (1) YEAR warranty, depending upon which is longer.
WHAT IS NOT COVERED BY THIS WARRANTY?
This warranty does not apply to any non-MARBELLA branded hardware products or any software, even if packaged or sold with MARBELLA hardware. Manufacturers, suppliers, or publishers, other than MARBELLA, may provide their own warranties to you but MARBELLA, in so far as permitted by law, provides their products "AS IS". Software distributed together with MARBELLA products with or without the MARBELLA brand (including, but not limited to system software) is not covered by this warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. MARBELLA does not warrant that the operation of the MARBELLA Product will be uninterrupted or error-free. MARBELLA is not responsible for damage arising from failure to follow instructions relating to the MARBELLA Product's use.
This warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish or deform over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to cosmetic damage, such as LCD/LED panel crack, scratches, nicks, dents and malfunction due to damage occurs due to damage of LCD/LED panel; (d) to damage caused by use with another product; (e) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (f) to damage caused by operating the MARBELLA Product outside MARBELLA's published guidelines; (g) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Maka GPS Technologies Group or an MARBELLA Authorized
Service Provider ("MASP"); (h) to an MARBELLA Product that has been modified to alter functionality or capability without the written permission of MARBELLA; (i) to defects caused by normal wear and tear or otherwise due to the normal aging of the MARBELLA Product, or (j) if any serial number has been removed or defaced from the MARBELLA Product.
IMPORTANT RESTRICTION
MARBELLA may restrict warranty service to the country where MARBELLA or its Authorized Distributors originally sold the MARBELLA Product.
MARBELLA’s navigation products are intended to be used only as travel guidance and must not be used for any purpose requiring precise measurement of direction, distance, location or topography, aviation. MARBELLA makes no warranty as to the accuracy or completeness of map data.
DO NOT CARRY-IN OR CLAIM YOUR WARRANTY SERVICE OR OPTIONS FROM MARBELLA LOCAL RETAILERS. Retail locations of MARBELLA Product(s) are NOT an authorized MASP nor authroised service location to repair your MARBELLA. YOUR WARRANTY POLICY MIGHT BE VOID if you carry-in your MAREBELLA device to an unauthorized location. Please proceed to the nearby MASP location offering carry-in service.
YOUR RESPONSIBILITIES
To obtain warranty service, an original or copy of the sales receipt from the original retailer is required. “MARBELLA” (Maka GPS Technologies Group or its own subsidiaries or MASP) may reject any warranty claims without producing a valid receipt from retailers.
YOU SHOULD MAKE PERIODIC BACKUP COPIES OF YOUR OWN MULTIMEDIA/NAVIGATION MAP INFORMATION CONTAINED IN THE MARBELLA PRODUCT'S STORAGE MEDIA TO PROTECT THE CONTENTS AND AS A PRECAUTION AGAINST POSSIBLE OPERATIQONAL FAILURES.
MARBELLA DOES NOT WARRANT YOUR HISTORY, FAVORITES DATA OR ANY COORDINATES HAS BEEN STORED INTO MARBELLA DEVICES EVEN WITHIN THE WARRANTY PERIOD.
Before receiving warranty service, MARBELLA or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow MARBELLA's procedures for obtaining warranty service. Before submitting your MARBELLA Product for warranty service you should maintain a separate backup copy of the files of its storage media, remove all personal information that you want to protect and reset security Bluetooth passwords to “1234”.
DURING WARRANTY SERVICE THE CONTENTS OF THE STORAGE MEDIA WILL BE DELETED AND REFORMATTED. MARBELLA AND ITS AGENTS ARE NOT RESPONSIBLE FOR ANY LOSS OF MULTIMEDIA FILES, DEVICE SETTING, NAVIGATION DATA (HISTORY, FAVORITES OR ANY GPS COORDINATES) OR OTHER INFORMATION CONTAINED ON THE STORAGE MEDIA OR INTERNAL MEMORY OR ANY OTHER PART OF THE MARBELLA PRODUCT SERVICED.
Following warranty service your MARBELLA Product or a replacement product will be returned to you as your MARBELLA Product was configured when originally purchased, subject to applicable updates. MARBELLA may install system software updates as part of warranty service that will prevent the MARBELLA Product from reverting to an earlier version of the system software. Third party applications installed on the MARBELLA Product may not be compatible or work with the MARBELLA Product as a
result of the system software update. Recovery and reinstallation of other software programs, data and information are not covered under this warranty.
Important: Do not open the MARBELLA Product by anyone who is not a representative of Maka GPS Technologies Group or an MARBELLA Authorized Service Provider ("MASP"); Opening the MARBELLA Product may cause damage that is not covered by this warranty. Only authorized MASP should perform service on this MARBELLA Product.
WHAT WILL MARBELLA OR MASP DO IN THE EVENT ITS STILL UNDER WARRANTY?
If during the Warranty Period you submit a valid claim to Maka GPS Technologies Group or an MASP, MARBELLA will, at its option,
(i) Repair the MARBELLA Product using new or previously used parts that are equivalent to new in performance and reliability,
(ii) Replace the MARBELLA Product with a product that is at least functionally equivalent to the MARBELLA Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or
(iii) If all parts been replaced and still not performing and beyond repair by MASP, MASP or MARBELLA may replace MARBELLA with refurbished or reverse engineer MARBELLA Product.
(iv) If all parts been replaced and still not performing or MARBELLA device is beyond repair by MASP only after FOURTEEN (14) CALENDAR DAYS after your retail purchase, with a proof of retail purchase, MASP, MARBELLA or authroised Marbella service centre will replace a brand-new MARBELLA Product.
WHAT WILL MARBELLA OR MASP DO IN THE EVENT THE WARRANTY IS BREACHED?
MARBELLA may request that you replace certain user-installable parts or products at a nominal fee. Servicing fees, parts availability and parts lead time may vary according to country. You may be responsible for shipping and handling charges if the MARBELLA Product cannot be serviced in the country/province or state it is in. If you seek service in a country that is not the original country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.
A replacement part or product, including a user-installable part that has been installed must be in comply with local governs regulations, assumes the remaining warranty of the MARBELLA.
Product or NINETY (90) DAYS from the date of replacement or repair, whichever provides longer coverage for your MARBELLA device. When a product or part is replaced provided, any replacement item becomes your property and the replaced or item becomes MARBELLA's property.
HOW TO OBTAIN WARRANTY SERVICE?
Please access and review the online help resources described below before seeking warranty service. If the MARBELLA Product is still not functioning properly after making use of these resources, please contact a MARBELLA representative or Maka GPS Technologies Group or its own subsidiaries or authorized distributor. A MARBELLA representative or MASP will help determine whether your MARBELLA Product requires service and, if it does, will inform you how MARBELLA will provide it. When contacting MARBELLA via telephone, other phone or data charges may apply depending on your location.

WARRANTY SERVICE OPTIONS
MARBELLA will provide warranty service through one or more of the following options:
(i) Carry-in service. You may return your MARBELLA Product to a nearby Service Centre authorized by Maka GPS Technologies Group or its own subsidiaries or MASP location offering carry-in service. Service will be performed at the location. Once you are notified that service is complete, you will promptly retrieve the MARBELLA Product from the MARBELLA Service Centre or MASP location.
DO NOT CARRY-IN OR CLAIM YOUR WARRANTY SERVICE OR OPTIONS FROM MARBELLA LOCAL RETAILERS. Retail locations of MARBELLA Product(s) are NOT an authorized MASP nor authroised service location to repair your MARBELLA. YOUR WARRANTY POLICY MIGHT BE VOID if you carry-in your MAREBELLA device to an unauthorized location. Please proceed to the nearby MASP location offering carry-in service.
(ii) Postage service. If MARBELLA determines that your MARBELLA Product is eligible for postage service, MARBELLA will re-direct your postage service to your nearby service centre or MASP location. You should securely pack the device and a copy of the original sales receipt, which is a compulsory requirement before MASP can commence any warranty repairs or investigations. Write the tracking number clearly on the outside of the package. Send the device, freight charges prepaid, to any MARBELLA warranty service station.
You may ship your MARBELLA Product to a MASP location or Service Centre authorized by Maka GPS Technologies Group or its own subsidiaries in accordance with MASP's instructions. Once service is complete, the MASP or MARBELLA authorized Service centre will return the MARBELLA Product to you. MARBELLA will pay for shipping to and from your location if all instructions are followed.
WARRANTY SERVICE OPTIONS – TEMPORAILY LOAN DEVICE
(a) Service where MARBELLA requires return of the replaced product or part which might take longer servicing period. MARBELLA users may require a temporarily loan set SUBJECT TO STOCK AVAILABILITY and MASP or MARBELLA will require a credit card authorization as security based the retail price. If you are unable to provide credit card authorization, temporarily loan service may not be available to you and MARBELLA will offer alternative arrangements for service.
If you fail to return the temporarily loan set replaced product or part as instructed or return a replaced product or part that is ineligible for service, MARBELLA will charge your credit card for the authorized amount based on the current retail price after THIRTY (30) DAYS after our first phone and collection notification via email notification.
(b) MARBELLA is not responsible for any labor or logistics costs you incur during your MARBELLA service not authorised by Maka GPS Technologies Group or its own subsidiaries or MASP location. Should you require further assistance, contact MARBELLA at the telephone number listed below.
MARBELLA reserves the right to change the method by which MARBELLA may provide warranty service to you, and your MARBELLA Product's eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested.
(c) Any cosmetic, accessories parts or LCD/LED panel damage incurred during your temporally loan service period, MARBELLA or MASP reserves the rights to charge you and parts pricing may vary according to country/province of your service location.
LIMITATION OF LIABILITY
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARBELLA IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE MARBELLA PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE MARBELLA PRODUCT.
THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. MARBELLA or MAKA GPS TECHNOLOGIES GROUP OR ITS OWN SUBSIDIARIES OR MASP LOCATION DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY MARBELLA PRODUCT UNDER THIS WARRANTY OR REPLACE THE MARBELLA PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED IN THE MARBELLA PRODUCT.
SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
PRIVACY
MARBELLA or Maka GPS Technologies Group or its own subsidiaries or MASP location will maintain and use customer information in accordance with the Marbella Customer Privacy Policy.
GENERAL
No MARBELLA reseller, agent, or employee of Maka GPS Technologies Group or its own subsidiaries or MASP location is authorized to make any modification, extension, or addition to this warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This warranty is governed by and construed under the laws of the country in which the MARBELLA Product purchase took place. MARBELLA is identified at the end of this document according to the country or region in which the MARBELLA Product purchase took place. MARBELLA or its successor in title is the warrantor under this warranty.

(iii) If all parts been replaced and still not performing and beyond repair by MASP, MASP or MARBELLA may replace MARBELLA with refurbished or reverse engineer MARBELLA Product.

(iv) If all parts been replaced and still not performing or MARBELLA device is beyond repair by MASP only after FOURTEEN (14) CALENDAR DAYS after your retail purchase, with a proof of retail purchase, MASP, MARBELLA or authroised Marbella service centre will replace a brand-new MARBELLA Product.

(v) MASP or Marbella service centre reserves right to impose service fee or service charge for map updating beyond your warranty period. Please contact your nearest MASP or Marbella service centre for more details.

WHAT WILL MARBELLA OR MASP DO IN THE EVENT THE WARRANTY IS BREACHED?

A replacement part or product, including a user-installable part that has been installed must be in comply with local governs regulations, assumes the remaining warranty of the MARBELLA.

Product or NINETY (90) DAYS from the date of replacement or repair, whichever provides longer coverage for your MARBELLA device. When a product or part is replaced provided, any replacement item becomes your property and the replaced or item becomes MARBELLA's property.

HOW TO OBTAIN WARRANTY SERVICE?

Please access and review the online help resources described below before seeking warranty service. If the MARBELLA Product is still not functioning properly after making use of these resources, please contact a MARBELLA representative or Maka GPS Technologies Group or its own subsidiaries or authorized distributor. A MARBELLA representative or MASP will help determine whether your MARBELLA Product requires service and, if it does, will inform you how MARBELLA will provide it. When contacting MARBELLA via telephone, other phone or data charges may apply depending on your location.

WARRANTY SERVICE OPTIONS

MARBELLA will provide warranty service through one or more of the following options:

(i) Carry-in service. You may return your MARBELLA Product to a nearby Service Centre authorized by Maka GPS Technologies Group or its own subsidiaries or MASP location offering carry-in service. Service will be performed at the location. Once you are notified that service is complete, you will promptly retrieve the MARBELLA Product from the MARBELLA Service Centre or MASP location.

DO NOT CARRY-IN OR CLAIM YOUR WARRANTY SERVICE OR OPTIONS FROM MARBELLA LOCAL RETAILERS. Retail locations of MARBELLA Product(s) are NOT an authorized MASP nor authroised service location to repair your MARBELLA. YOUR WARRANTY POLICY MIGHT BE VOID if you carry-in your MAREBELLA device to an unauthorized location. Please proceed to the nearby MASP location offering carry-in service.

(ii) Postage service. If MARBELLA determines that your MARBELLA Product is eligible for postage service, MARBELLA will re-direct your postage service to your nearby service centre or MASP location. You should securely pack the device and a copy of the original sales receipt, which is a compulsory requirement before MASP can commence any warranty repairs or investigations. Write the tracking number clearly on the outside of the package. Send the device, freight charges prepaid, to any MARBELLA warranty service station.

You may ship your MARBELLA Product to a MASP location or Service Centre authorized by Maka GPS Technologies Group or its own subsidiaries in accordance with MASP's instructions. Once service is complete, the MASP or MARBELLA authorized Service centre will return the MARBELLA Product to you. MARBELLA will pay for shipping to and from your location if all instructions are followed.

WARRANTY SERVICE OPTIONS – TEMPORARILY LOAN DEVICE

(a) Service where MARBELLA requires return of the replaced product or part which might take longer servicing period. MARBELLA users may require a temporarily loan set SUBJECT TO STOCK AVAILABILITY and MASP or MARBELLA will require a credit card authorization as security based the retail price. If you are unable to provide credit card authorization, temporarily loan service may not be available to you and MARBELLA will offer alternative arrangements for service.

If you fail to return the temporarily loan set replaced product or part as instructed or return a replaced product or part that is ineligible for service, MARBELLA will charge your credit card for the authorized amount based on the current retail price after THIRTY (30) DAYS after our first phone and collection notification via email notification.

(b) MARBELLA is not responsible for any labor or logistics costs you incur during your MARBELLA service not authorised by Maka GPS Technologies Group or its own subsidiaries or MASP location. Should you require further assistance, contact MARBELLA at the telephone number listed below.

MARBELLA reserves the right to change the method by which MARBELLA may provide warranty service to you, and your MARBELLA Product's eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested.

(c) Any cosmetic, accessories parts or LCD/LED panel damage incurred during your temporally loan service period, MARBELLA or MASP reserves the rights to charge you and parts pricing may vary according to country/province of your service location.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARBELLA IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE MARBELLA PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE MARBELLA PRODUCT.

THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. MARBELLA or MAKA GPS TECHNOLOGIES GROUP OR ITS OWN SUBSIDIARIES OR MASP LOCATION DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY MARBELLA PRODUCT UNDER THIS WARRANTY OR REPLACE THE MARBELLA PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED IN THE MARBELLA PRODUCT.

SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

PRIVACY

MARBELLA or Maka GPS Technologies Group or its own subsidiaries or MASP location will maintain and use customer information in accordance with the Marbella Customer Privacy Policy.

GENERAL

No MARBELLA reseller, agent, or employee of Maka GPS Technologies Group or its own subsidiaries or MASP location is authorized to make any modification, extension, or addition to this warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This warranty is governed by and construed under the laws of the country in which the MARBELLA Product purchase took place. MARBELLA is identified at the end of this document according to the country or region in which the MARBELLA Product purchase took place. MARBELLA or its successor in title is the warrantor under this warranty.
